An assignment of rights to medical support from any absent parent of a child who is under age eighteen and who is deprived of parental support or care is automatic under North Dakota state law. (Refer to Section 05-35-10 for the description of deprivation.)

The assignment of rights to medical support from absent parents continues through the month in which the child reaches the age of eighteen or until the child’s eligibility for assistance ends, whichever occurs first.

An automated referral will be made to Child Support for all children whose deprivation is based on the absence of a parent.
